USER AGREEMENT
Your use of MyPrintEasy.com constitutes as your agreement to the Terms and Conditions outlined on this page. Your agreement to these Terms and Conditions is bound by accessing any pages under the MyPrintEasy.com domain. MyPrintEasy.com reserves the right to, at any time, update these Terms and Conditions without formal notice. By accessing any page under the MyPrintEasy.com domain after any updates to the Terms and Conditions you agree at that time to be bound to the updated Terms and Conditions.
Your access to the MyPrintEasy.com web site, completely or partially, may be terminated or suspended for any reason without notice, at any time.
ORDER PROCESS
Prices shown for all products on MyPrintEasy.com are in US Dollars (USD), unless stated otherwise. All orders are to be paid in full, including shipping and handling, before we will begin production for those orders. Upon order confirmation, you agree that all charges for that order will be charged to the credit card or other approved payment method designated at the time of checkout.
MyPrintEasy.com charges sales tax to all orders received within the State of California, unless certification of tax exemption is provided.
MyPrintEasy.com will provide proofs in PDF format for all orders. MyPrintEasy.com will not begin production of any order without approval from the customer of said proof; therefore, MyPrintEasy.com is not responsible for any delays caused by your failure to approve said proof. After approval is received from the customer of said proof, no changes to artwork or printing priority will be made.
MyPrintEasy.com does not make any changes to the files provided by the customer. Therefore MyPrintEasy.com is not liable for any errors to the final product caused by the following reasons:
• Typographical errors such as misspellings, grammar or punctuation
• Graphical errors, such as missing images, misshaped images, missing text and missing fonts
• Production errors caused by the files provided by the customer, such as wrong cuts due to unnecessary crop marks, incorrect folding, and final product size
You agree by submitting your artwork to MyPrintEasy.com that you have the right to use the content and images within your artwork. MyPrintEasy.com reserves the right to refuse any order that may be illegal in nature or may infringe on the rights of any third party. You accept full legal liability for any and all of the content produced on your behalf, under your instruction. MyPrintEasy.com also reserves the right to refuse any order without disclosing a reason.
You agree to be solely responsible for providing accurate, valid, and current billing and shipping information when placing an order. MyPrintEasy.com is not responsible for any delays or errors caused by or related to your failure to provide a valid email address, valid shipping address, valid billing information or other technical issues beyond the control of MyPrintEasy.com. MyPrintEasy.com reserves the right to refuse processing any orders if invalid or inaccurate billing information is provided.
ACCOUNTS
MyPrintEasy.com requires its customers to establish an account in order to upload or store any media; therefore an account is also required in order to complete any order. MyPrintEasy.com agrees to take every precaution in order to safeguard your media, but is not responsible for the loss or damage of any stored media. As part of the account registration process, you as the user are required to utilize a current and valid email address, along with a unique password. You agree to be solely responsible for the accuracy of the information provided and for keeping your password secure. Therefore you agree to be entirely responsible for all activities that occur under your account.
MyPrintEasy.com agrees to keep all email, password and billing information strictly confidential, as specified in our Privacy Statement . MyPrintEasy.com must be notified immediately of any breach of security or unauthorized use of your account. You agree not to use anyone else’s account but your own, at any time, unless granted permission to do so by the account holder. MyPrintEasy.com will not be held liable for any loss incurred as a result of someone else using your account with or without your knowledge.
COLOR
MyPrintEasy.com guarantees that its products will not be defective in accordance with the standards of the commercial printing industry. MyPrintEasy.com does not guarantee an exact match in color fidelity or density. MyPrintEasy.com is not responsible for any changes in color that occur due to the conversion in color space from RGB to CMYK. MyPrintEasy.com uses the GRACoL2006 Coated 1V2 color profile, and therefore recommends you review your artwork using that profile before submitting. MyPrintEasy.com does not guarantee the colors of its products will match the colors as they appear on display monitors, as we cannot compensate for variances between the monitors of individual customers and our own, to that of the final product. MyPrintsEasy.com is not responsible for the final color appearance of UV coated products, as UV coating affects the appearance of the colors to which it is applied.
TURNAROUND
Turnaround time begins for an order once MyPrintEasy.com has received approval from the customer for all PDF proofs relating to that order, and full payment has been received for that order. Turnaround time refers to time in production, including but not limited to, printing, coating, cutting, scoring, folding, collating, binding and packing. Shipping time is not included in turnaround time and is determined by the shipping method selected for the order. MyPrintEasy.com is not open Saturdays, Sundays or National holidays, therefore these days are not calculated in the turnaround time.
Turnaround time, as defined above, is guaranteed by MyPrintEasy.com. Compensation for failure to meet our quoted turnaround time is limited to a pro-rated refund of the rush charges or a discount toward a future order. Cancellations for failed turnaround time are only warranted if a future discount is denied and the artwork displays a date indicating the product was time-sensitive.
MyPrintEasy.com generally sends proofs to the customer via email within 2 business hours of the time an order is placed through MyPrintEasy.com. All proofs must be approved and full payment received before 3:30 PM, PST, for that order to be included in production for that day. If all proofs for an order are approved before 3:30 PM, PST and one-day printing priority was selected, it will ship out or be ready for pick up the following business day. Any printing priority selected greater than one day will increase production time accordingly as the priority is lessened.
MyPrintEasy.com’s normal business hours are between 8:00 AM to 5:30 PM, PST, Monday through Friday. MyPrinteasy.com does not process new orders or generate proofs during non-business hours. MyPrintEasy.com is not open Saturdays, Sundays or National holidays, therefore these days are not calculated in the turnaround time.
SHIPPING
MyPrintEasy.com uses various third-party service providers to deliver and mail your orders. These third-party providers include, but are not limited to The United States Post Office (USPS), United Parcel Service (UPS), and FedEx. MyPrintEasy.com is not liable for any delivery problems, delays, damages or losses that may occur as a result of the third-party delivery provider, invalid shipping information, or acts of nature. MyPrintEasy.com cannot ship to P.O. Boxes or APO/FPO. MyPrintEasy.com will provide appropriate tracking information via email for all orders shipped out using a third-party delivery provider.
MyPrintEasy.com will notify customers via email when orders are available for pick up. Pick Up orders will be held available for pick up for 30 days from the time the email notification is sent. All orders that have not been picked up within the 30 days allotted will be shipped to the customer via Ground, at which time the customer will be billed for the applicable shipping charges.
REFUND POLICY
Once full payment and approval of all PDF proofs for an order have been received, that order is considered in production. No refunds are given for any orders once they are in production, all sales are final.
MyPrintEasy.com must be notified of any complaints regarding an order, within 3 business days of the order’s delivery date. After an investigation, if MyPrintEasy.com concludes it is at fault for the error or defect, then MyPrintEasy.com will reprint the order using the original print priority and ship it out using the original shipping method.
For all reprints, at least 95% of the original defective product must be returned to MyPrintEasy.com, at the customer’s expense. Reprinted orders will not be shipped out until the customer provides ship tracking information for the returning product to MyPrintEasy.com. The ship tracking information for the returning product must be received within 5 business days from the time the reprint is offered to the customer, or the offer to reprint is no longer valid.
In certain cases, MyPrintEasy.com will offer a discount code, credit toward a future order, partial refund, or full refund as compensation, instead of a reprint. If one of these types of compensation is offered and accepted, the customer’s right to a reprint is waived.
SITE USAGE RESTRICTIONS
You agree that you have read, understood and found the MyPrintEasy.com Privacy Statement and Terms and Conditions to be reasonable. You may not use this site to make any false or fraudulent requests or purchases. You many not use any form of automation to access the site to make requests or purchases. You agree that you are of legal age to be liable for any obligations that may occur as a result of using this site and are of legal age to create such a binding legal obligation. You agree to keep your account information up to date and accurate. Fraudulent users will be prosecuted to the fullest extent of the law.
LIMITATION OF LIABILITY
You agree that MyPrintEasy.com and its respective officers, directors, employees, agents, vendors, affiliates or subcontractors, shall not be liable for any accident, injury, death, loss, claim, delay, damage, or act of god, be it direct, indirect, punitive, incidental, special, consequential or exemplary, as a result of your using or your inability to use the MyPrintEasy.com web site. This includes, but is not limited to, loss of profits, time, or data, even if MyPrintEasy.com has been notified of such losses or damages.
You agree that if a covered party is found liable for any loss or damage as a result of using the MyPrintEasy.com web site, the liability of said party shall not exceed the cost assessed by MyPrintEasy.com. If the limitation of liability does not apply to the extent of the law in your state, not including California, then the limitations might not apply to you.
ENTIRE AGREEMENT
These Terms and Conditions constitute the entire agreement between you and MyPrintEasy.com, superseding any prior agreements between you and MyPrintEasy.com. These Terms and Conditions shall be governed by the laws of the State of California, without regard to its conflict of law principles. You consent to the exclusive jurisdiction of the courts of Orange County, California for all disputes related to or arising from these Terms and Conditions. If any provision of these Terms and Conditions is found to be illegal, invalid or unenforceable, the remaining provisions will not be affected in any way.
You agree to indemnify and hold MyPrintEasy.com harmless from any claims and demands, including attorneys’ fees, arising from or related to your use of the MyPrintEasy.com web site. You also agree that you own the rights to or have a license to use any and all images being used to produce the products for your order.
COPYRIGHT
All content on this web site, including but not limited to, typefaces, logos, graphics, images, icons, designs, verbiage, online tools, software, partner portals, data compilations, products, and services (collectively, "Content") that are under the MyPrintEasy.com domain are the intellectual property and copyrighted works of MyPrintEasy.com (and as applicable, its licensors). All "Content" is protected by United States and International copyright laws, other intellectual property laws, and MyPrintEasy.com reserves any rights not expressly granted herein.
